NOTICE IS HEREBY GIVEN of the intention of the Board of Education of the Berkeley Unified School District (“District”) to consider entering into an energy services contract (“Agreement”) with Schneider Electric Buildings America, Inc. (“Schneider”) to install certain solar photovoltaic systems and energy storage systems at the Berkeley High School pool complex, pursuant to the terms of Government Code section 4217.12.
The time for the public hearing on the intention of the Board to consider entering into the Agreement with Schneider is June 23, 2021 at 7:00 p.m., or as soon thereafter as practicable, during the Board’s regular meeting. For the duration of the COVID-19 public health crisis, Board meetings will be held on Zoom. Pursuant to the Governor’s Executive Order N-25-20, all members of the Board of Education as well as the Superintendent and District Staff, will join the meeting via phone/video conference and no teleconference locations need to be posted. At such time, the testimony of all interested persons for or against the proposed Agreement will be heard. There are two opportunities for public comment at each Board meeting: (1) at the beginning of the 7:00 pm open session; and (2) in extended public comment near the end of the meeting.
Any protest pertaining to the regularity or sufficiency of the proceedings shall be in writing and shall clearly set forth the irregularities and defects to which the objection is made. Any written protest shall be filed with the Board of Education on or before the time set for the hearing. The District may waive any irregularities in the form or content of any written notice and at the hearing may correct minor defects in the proceedings. Written protests may be withdrawn, in writing, at any time before the conclusion of the hearing.
